Delivery & Hauling Disclaimer

PLEASE READ CAREFULLY BEFORE ARRANGING DELIVERY

Millican Materials, LLC strictly supplies earthwork materials and does not operate a delivery fleet or employ transit drivers. For your convenience, we maintain partnerships with trusted independent local haulers and can recommend third-party transportation services to bring materials directly to your site.

By requesting a hauling referral or coordinating a delivery through an independent partner carrier, you explicitly acknowledge and agree to the following terms:

1. Independent Contractor Status

All hauling, transport, and delivery services are performed by independent, third-party owner-operators or logistics corporations. These carriers are not employees, agents, or joint-ventures of Millican Materials, LLC.

2. Property Damage Waiver

  • Site Access: It is the customer's sole responsibility to ensure the delivery site has adequate clearance, overhead space (clear of power lines and tree branches), and ground stability to support heavy commercial dump trucks.

  • Liability: Millican Materials, LLC assumes zero liability for damages caused by the independent delivery vehicles to private property, including but not limited to: cracked driveways, damaged sidewalks, broken culverts, torn underground utilities, ruts in lawns, or damage to gates and fences.

3. Drop-Site Discretion

Delivery drivers reserve the absolute right to refuse to dump materials in an area they deem unsafe, muddy, unstable, or inaccessible. In such events, the driver will dump materials at the nearest safe, clear location on the property (such as the curbside or driveway apron).

4. Delays and Timelines

While we communicate project timelines with our partner haulers with the utmost urgency, Millican Materials, LLC is not legally responsible for project delays, labor standby costs, or financial losses caused by independent transport delays, traffic conditions, weather closures, or vehicle breakdowns.

5. Material Acceptance

Once a bulk delivery is dumped on-site and accepted by the customer or the customer's designated job site representative, the material sale is considered final. Any concerns regarding material volume or quality must be reported to Millican Materials yard management before the truck dumps the load.
